1. Introduction

As part of its business of selling customizable digital treasure hunts, ALPIUM processes information about you. For example, when you fill in a registration form, create games on our website game.escape-gift.com, contact our Customer Service or browse our websites, you send us information, some of which may identify you (“personal data”).

This Privacy Policy explains how we collect and process your personal data. Please read it carefully.

Important

We only use your personal data in the cases provided for by the regulations in force:

• The performance of a contract we have entered into with you, and/or
• Compliance with a legal obligation, and/or
• Your consent to the use of your data, and/or
• The existence of a legitimate interest in using your data. A legitimate interest is a set of commercial or business reasons that justifies the use of your data by ALPIUM.

For ALPIUM, this legitimate interest is mainly to sustain the level of commercial revenue needed to fund the treasure hunt creation platform and to keep some content on its websites free of charge.

In any event, your individual rights will always prevail over our legitimate interest, and we will never use your data for commercial purposes against your will.

2. Who is the data controller for the processing described in this document?

The data controller for the processing described in this document is ALPIUM, a limited liability company (SARL) with a share capital of €8,000, whose registered office is located at 112 voie Albert Einstein, 73800 Francin, France, registered with the Albertville Trade and Companies Register (RCS) under number 444 199 210 000 48, and whose legal representative is Mr. Mikhaël Bahmed. The data protection officer is Mikhaël Bahmed.

3. What data do we collect about you, and in what circumstances?

3.1. Data you provide directly

During our various interactions with you, you may share information about yourself with us. This information is collected in particular when you create an account and pay for digital treasure hunts on our websites.

This data includes in particular:

• Last names, first names;
• Postal address, email address;
• Username and encrypted password used to identify you on our websites;
• Encrypted information about your payment methods (in particular your card number);
• Any other information you wish to share with us.

– Contact forms on the www.escape-gift.com website

When you write to us using a contact form on the www.escape-gift.com website, you send us your name, your email address, and the subject and text of your message. This information is used only to answer your request. It is sent to us by email and is not stored on the website: only the email we receive is kept, in our mailbox (see Article 5). To prevent abuse, the server keeps a count of submissions per IP address, in the form of an irreversible hash rather than the address in plain text. This counter is no longer taken into account after one hour, and is then deleted automatically on a later submission.

3.2. Data we collect in the course of our business relationship

The data we collect in the course of our business relationship with you includes in particular:

• Information about the history of your business relationship with ALPIUM: orders for services and, where applicable, invoicing and payment;
• Your participation in promotional offers;
• Requests you have made to our customer service or incidents you have reported to us, for example concerning the performance of our services.

3.3. Data we collect when you create a treasure hunt

When you create an online treasure hunt on our website, we need to store the information you provide so that we can show it to the players (the participants you have selected). This information includes in particular:

• Text
• Images
• Internet links to external websites
• The players’ email addresses and nicknames, when you enter them yourself.

We also need to store information about the players to ensure fairness, calculate the scores and make sure your treasure hunt works properly. This information includes in particular:

• The players’ email addresses and nicknames, when they enter them themselves.
• The players’ answers

All the data mentioned in this section is used only within your treasure hunt. Only you and the participants in your treasure hunt have access to it. This information is not analyzed, shared or used for commercial purposes outside this context. When you contact our support team, the information in your treasure hunt may be viewed at your request in order to solve a technical problem.

You can modify, delete or add information in your treasure hunts at any time. We do not keep any history of changes.

You can also delete a treasure hunt at any time; this will permanently and irreversibly delete all the information in your treasure hunt.

3.4. Data we collect automatically

– On the www.escape-gift.com website

Until you start a YouTube video (see below), the www.escape-gift.com website sets no cookies and shows no advertising or social media buttons. This website measures its audience with an in-house tool, with no cookie and no third party: IP addresses are never stored, the pseudonymous identifier changes every day, only the country is kept, and raw data is deleted within 7 days. You can opt out by enabling your browser’s Global Privacy Control (or “Do Not Track”) signal. Like any web server, our host’s server technically logs connections (IP address, page requested, date and time, browser used) to keep the website secure and working properly. YouTube videos are only loaded if you click them, from the youtube-nocookie.com domain; YouTube may then store information on your device (cookies, local storage) and applies its own privacy policy (Google Privacy Policy). – On the game.escape-gift.com application: data collected through cookies

Each time you visit the game.escape-gift.com application, we collect information about your connection and your browsing. Various technologies may be used to collect this data. We refer to them generically as “cookies”. You can change your settings at any time on the application’s Cookie management page.

A cookie is a text file placed on your device when you visit a website, use a mobile application or view an online advertisement, and stored in a specific area of the hard drive of your computer or mobile device. Cookies are managed by your web browser or by the mobile application you use, and only the issuer of a cookie can decide to read or modify the information it contains.

A cookie has a limited period of validity. It is placed and stored on your device in accordance with the applicable legislation and subject to the choices you have expressed, which you can change at any time under the conditions set out in Article 9 below.

• Identifiers of the device you use (your computer’s IP address, Android ID, Apple device identifier, etc.),
• Type of operating system used by your device (Microsoft Windows, Apple OS, Linux, Unix, BeOS, Android, iOS, etc.),
• Type and version of the browser software used by your device (Microsoft Internet Explorer, Apple Safari, Mozilla Firefox, Google Chrome, etc.),
• Dates and times of connection to our services,
• Address of the web page you came from (“referrer”),
• Browsing data on our services, content viewed.

– On the game.escape-gift.com application: data collected through standard Internet technologies

We may also use standard Internet technologies, such as scripts and redirects. Scripts (sometimes called tags), written in JavaScript, are programs that run in your browser or mobile application and perform various actions, for example sending information to our servers. Redirects make a web page available at several page addresses (URLs). When a browser opens a redirect URL, a page with a different URL opens.

The purpose of these technologies is to improve your experience on our websites and applications.

These technologies give us access in particular to the following information:

• Information about your use of our websites;
• Information about the presence of cookies on your device, the time and date a page was viewed, and a description of the page on which the web beacon is placed.

3.5. Data relating to minors

In principle, our products and services are intended for adults with the legal capacity to enter into contractual obligations.

A minor user must obtain the consent of their legal guardian before providing any personal data about themselves.

3.6. No sensitive data

ALPIUM does not collect any sensitive data about you. Sensitive data includes: racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, and data concerning health or sexual orientation. If such information were somehow communicated to ALPIUM, it would be deleted.

4. For what purposes do we use your data?

This article sets out the main purposes for which we use the data mentioned in Article 3.

4.1. Operations necessary to provide our services

• Processing your registration on our website;
• Processing your order for services and fulfilling that order;
• Managing subscriptions to our newsletters and/or email alerts;
• Invoicing; collecting payments;
• Managing deliveries and order tracking;
• Customer relations: providing a Customer Service available by mail, telephone, email or instant messaging (chat), for any question or complaint;
• Answering messages sent through the contact forms on the www.escape-gift.com website;
• Conducting satisfaction surveys;
• Sending information about changes to or developments in our services;
• Managing unpaid invoices and disputes; preventing fraud;
• Managing the exercise of your rights over your personal data, under the conditions set out in Article 9;
• Checking compliance with the applicable legislation, our contracts and our terms of use.

• Personalized loyalty or commercial prospecting campaigns;
• Running contests or other promotional operations;
• Collecting customer reviews;
• Producing commercial statistics.

4.3. Operations related to commercial partnerships

• Sharing, exchanging or renting files with commercial partners in compliance with the regulations in force and with security requirements;
• Sending marketing, advertising and promotional messages about partners’ products and services by email, mobile notifications, on social networks or any other medium;
• Running contests or other promotional or event operations with commercial partners.

4.4. Purposes associated with placing cookies on your browser (game.escape-gift.com application)

The www.escape-gift.com website sets no cookies. For the www.escape-gift.com website, audience measurement is carried out by an in-house tool, for statistical purposes only (see section 3.4). The purposes below concern the game.escape-gift.com application.

– Operation and optimization of browsing and of the use of the services of our websites and applications

• Adapting the presentation of our websites and applications to the display preferences of your device (language used, display resolution, operating system, etc.) during your visits, according to the viewing or playback hardware and software on your device;
• Storing information relating to a form you have filled in on our website (registration or access to your account) or to products, services or information you have chosen on our website (service subscribed to, content viewed, purchase made, etc.);
• Automatic login to the reserved or personal areas of our website, such as your account, using identifiers or data you have previously entrusted to us;
• Providing tools for sharing on social networks;
• Managing our platforms and carrying out internal technical operations for troubleshooting, data analysis, testing, research, analyses, studies and surveys;
• Implementing security and anti-fraud measures;
• Quality measurements to make sure our content is displayed properly on your device;
• Access to audiovisual and interactive content.

– Traffic and audience measurement

• Compiling statistics and volumes of traffic and use of the various elements of our website (sections and content visited, paths) in order to improve the relevance and usability of our services;
• Improving our knowledge of customers/users for personalization purposes.

5. How long do we keep your data?

Your personal data is kept for a period that complies with the legal provisions or is proportionate to the purposes for which it was recorded. Some retention periods reflect ALPIUM’s legitimate interest as specified in the introduction.

Retention periods vary depending on whether we have an ongoing contractual relationship with you (you are an active customer), have had a contractual relationship with you in the past (you are an inactive customer) or have never had such a relationship with you (you are then a prospect). Messages received through the contact forms on the www.escape-gift.com website are kept only as the email received in our mailbox, for these same periods. Data relating to your browsing on the game.escape-gift.com application, collected by the cookies you have accepted, has a specific retention period.

The tables below show the main retention periods for your data.

In any event, we regularly review the information we hold. When keeping it is no longer justified by legal or commercial requirements or by the management of your customer account, or if you have exercised a right to rectification or erasure, we will delete it securely.

6. Who may have access to the data we collect?

6.1. Access to data within ALPIUM

The following may have access to some of your data:

• Staff in the subscriptions, customer relations, administration, accounting and management control, IT, and marketing & sales departments.

Access to your data is based on individual and limited access authorizations. Staff who can access personal data are bound by a duty of confidentiality (through a named, personal confidentiality undertaking).

6.2. Disclosure of data

The following may have access to some of your data:

– Our web host

OVH SAS, 2 rue Kellermann, 59100 Roubaix, France, hosts the www.escape-gift.com and game.escape-gift.com websites. It is from its servers that the website’s contact forms send us your messages.

– Google LLC (Google Forms questionnaire)

If you answer our feedback questionnaire about the pregnancy announcement, your answers are collected by Google Forms, a service of Google LLC, in accordance with its own privacy policy.

– The police, judicial or administrative authorities

When we are legally required to do so, or in order to protect the rights, property and safety of ALPIUM.

– The players (the participants you have selected) of your treasure hunt

When you share a treasure hunt, the players have access to the texts, images and Internet links you include in the game. You are solely responsible for the treasure hunt’s distribution list and its content. If a player is registered by mistake or becomes unwanted, you can remove them from the list of players at any time.

7. Is your data transferred outside the European Union?

We store your personal data in the European Union. However, some processing involves transfers to processors or commercial partners located in other countries, some of which may have personal data protection legislation that is less protective than that in force in your country of residence. In the event of such a transfer, we ensure that the processing is carried out in accordance with this privacy policy and that it is governed by the European Commission’s standard contractual clauses, which guarantee a sufficient level of protection of people’s privacy and fundamental rights.

8. How is your data protected?

As data controller, we implement appropriate technical and organizational measures, in accordance with the applicable legal provisions, to protect your personal data against alteration, accidental or unlawful loss, and unauthorized use, disclosure or access, including:

• Raising awareness of confidentiality requirements among our staff who access your personal data;
• Securing access to our premises and IT platforms;
• Implementing a general IT security policy for the company;
• Securing data access, sharing and transfer;
• Applying a high standard of data protection when selecting our processors and partners.

9. What are your rights?

9.1. Your rights regarding access to your personal data

You have the right of access to your personal data and the right to request that it be rectified, completed or updated. You can also request the erasure of your data or object to its processing, provided you have a legitimate reason.

You can ask to exercise your right to data portability, i.e. the right to receive the personal data you have provided to us in a structured, commonly used format, and the right to transmit this data to another data controller.

Finally, you can give instructions regarding the retention, erasure and disclosure of your personal data after your death.

Before responding to your request, we may verify your identity and/or ask you to provide more information so that we can respond. We will endeavor to respond to your request within a reasonable time and, in any event, within the time limits set by law.

If you are not satisfied with our response, you can lodge a complaint with the CNIL (Commission nationale de l’informatique et des libertés), the French data protection supervisory authority: https://www.cnil.fr/fr/plaintes (in French)

9.2. Your rights regarding objection to commercial solicitations

We may use your contact details for commercial solicitations, in accordance with the applicable law and the provisions of this privacy policy. You can object to these solicitations at any time, in ways that depend on the communication channel we use to send them to you.

– Electronic commercial solicitations (email and SMS):

We comply with the rules of Article L.34-5 of the French Postal and Electronic Communications Code, which requires your prior and express consent before we send you commercial prospecting by electronic means (email, push notifications or SMS).

Accordingly, on the forms you fill in when you subscribe to one of our products or services, when you create an account on our websites or applications, or during any other contact with us, you are expressly asked for your consent to receive offers from ALPIUM.

Exception: your prior express consent is not required when you are already an ALPIUM customer and the purpose of our solicitation is to offer you products or services similar to those we already provide to you.

In all cases, you can always object to receiving these solicitations by doing the following:

• For email, by clicking the unsubscribe link provided in each email, by going to your online account or by contacting our customer service.
• For SMS, by texting STOP to the number indicated in the message or by contacting our customer service.

– Commercial solicitations by telephone

We may contact you by telephone to offer you products or services. If you do not wish to be contacted, you can register on Bloctel, the French telephone marketing opt-out list, at www.bloctel.gouv.fr

– Solicitations by any other means

Please contact our customer service to let them know that you do not wish to receive these solicitations.

9.3. Your rights regarding the acceptance and management of cookies

The www.escape-gift.com website sets no cookies, so there is nothing for you to configure. If you play a YouTube video, it is loaded from the youtube-nocookie.com domain; YouTube may then store information on your device (cookies, local storage) and applies its own privacy policy (Google Privacy Policy).

On the game.escape-gift.com application, except where a specific exemption applies, a cookie is stored on your browsing device only if you so wish. You can change your choices regarding the acceptance or refusal of cookies on your device at any time, either via the application’s Cookie management page, which lets you configure cookies by category (cookies necessary for the website to work properly, audience measurement cookies), or in your browser, or online with various operators.

To manage cookies as closely as possible to your wishes, we invite you to configure your browser taking into account the purpose of the cookies.
